and Gains Coverage Affirmatively
Beecher Carlson was originally retained solely in the capacity as a Claims Consultant for a large, multi-billion dollar publicly traded REIT. They were embroiled in litigation as well as a coverage dispute with their primary D&O carrier. Their coverage counsel suggested they speak with us prior to commencing litigation with the carrier. We were able to extract some additional funds in recovery, but it was insufficient from our perspective on the coverage issue.The results: while the coverage at issue was never affirmatively granted in the past, we were able to convince a market to offer the coverage affirmatively, became the broker of record and had the client move to this carrier. Ultimately, the balance of the marketplace responded by offering this coverage as an enhancement on their traditional D&O policies.
